Heard the representative appearing on behalf of the petitioner. The grievance of the petitioner is that the appeal was dismissed by the State Commission for want of prosecution on the ground that no one had appeared for the Appellant on 22.3.10, 3.5.10, 3.6.10 and 13.7.10. The grievance of the petitioner before us is that in appeal memo it had been stated that all grounds and facts of the appeal are submitted through arguments by the appellant. It is, therefore, submitted that no further argument was required to be advanced by the petitioner. In view of this submission in appeal memo, the State Commission should have in fact passed appropriate order on admission of appeal after going through the record even if the petitioner was not present. In view of this, the impugned order of the State Commission is set aside and the State Commission shall peruse the records and pass appropriate order on admission of appeal. The revision is allowed in aforesaid terms with no order as to costs.
