The appellants are the opposite parties/BSNL in OP:77/04 in the file of CDRF, Kottayam.  The appellants are under orders to pay a compensation of Rs.2000/- and cost of Rs.750/- to the complainant.

2. The case of the complainant is that his telephone connection has been disconnected on the ground that his daughter in law who was residing at New Delhi had arrears of telephone charges Rs.56,716/-.

3. It is the case of the opposite parties/appellants that they are entitled to do so as the daughter in law of the complainant is at present residing with the complainant.  During the pendency of the proceedings as per the order of the Forum the telephone was reconnected.  The petitioner is an elderly person suffering from various ailments.  Evidently the appellant is not empowered to disconnect the telephone of a person for the arrears of telephone charges due to another.  In fact the amount ordered to be paid as compensation is on the lower side.  We find that there is no scope for admitting the appeal.  The appeal is dismissed in-limine.

The office will forward a copy of this order along with the LCR to the Forum urgently.
