None has appeared on behalf of the applicant.

We have perused the record.

This miscellaneous application has been filed by the applicant for releasing the amount of Rs. 8,11,555/-, which was deposited by the applicant before this Commission towards mandatory deposit while filing First Appeal No. 263 of 2022; The New India Assurance Company Limited Vs. M.M. Construction (Engineering and Construction).

The aforesaid appeal was filed by the applicant before this Commission against the judgment and order dated 23.09.2022 passed by the District Commission, Nainital in consumer complaint No. 15 of 2021; M.M. Construction (Engineering and Construction) Vs. Branch Office, The New India Assurance Company Limited.

This Commission vide order dated 02.11.2023 has partly allowed the aforesaid appeal.

According to office report dated 22.06.2024 / 08.07.2024, in compliance of the judgment and order dated 02.11.2023 passed by this Commission, the applicant has deposited the entire decretal amount before the District Commission.  

In view of above, the miscellaneous application is allowed.  The aforesaid amount of Rs. 8,11,555/- (Rupees Eight Lacs Eleven Thousand Five Hundred Fifty Five Only) deposited by the applicant with this Commission, be released in favour of the applicant.

File be consigned to the record room along with copy of this order.
