Today is fixed for filing show cause by both parties.

It is now 04:00 PM.

On repeated calls neither the complainant nor the O.P. is present when the case is taken up.

As per order No. 07 dated 23.12.2016 show cause petitions have not been filed by either parties and record shows that the complainant was absent on several occasions (6 dates after filing of this case) including this day. The conduct of the complainant shows that he has lost his interest in this case. So, there is no alternative but to dismiss the case.

Hence it is

                           Ordered  

that the case being No.CC-49/2016 be and the same is dismissed for default without cost.

Copies of this order be supplied to the parties free of cost.
