By Smt. Padmini Sudheesh, President:

The case of complainant is that the complainant and respondent entered into an agreement for making of window frame and doors to the complainant’s house and given Rs.34,920/- to the respondent. It was agreed to construct the front door in teakwood and others in Irul wood within a month. But it was done after three months. The respondent constructed the front door in teakwood and others in low quality wood. The windows and doors which were made on low quality wood became damaged. So the complainant was sustained heavy loss and lawyer notice was issued. The respondent did not send a reply and the matter was not settled. Hence the complaint.

            2. The respondent called absent and set exparte.

            3. In order to prove the case the complainant filed Affidavit and three documents. The documents are marked as Ext. P1 to P3.

            4. According to the complainant, the respondent failed to act in accordance with the agreement entered into between them. The respondent accepted Rs.34,920/- without fulfilling the conditions in the agreement. So this complaint is filed to get refund of the amount paid and compensation.

            5. There is no evidence to the contrary.

            6. In the result, the complaint is allowed and the respondent is directed to return Rs.34,920/- (Rupees thirty four thousand nine hundred and twenty only) to the complainant and Rs.10,000/- (Rupees ten thousand only) as compensation with cost Rs.1000/- (Rupees one thousand only) within one month.
