          This appeal coming up before us for hearing today, this commission made the following order in open court :-

 

JUSTICE S.TAMILVANAN, PRESIDENT  (Open court)

 

1.        The 1st opposite party is the appellant.

 

2.       Memo and proof filed by the appellant counsel.

 

3.       The appellant counsel appeared, and submitted that he had no objection in remanding the matter, back to the District Forum.  Under such circumstances,  we are inclined to remand the matter to the District Forum, for fresh disposal, according to law.

 

4.       In the result, the appeal is allowed, setting aside the order of the District Forum in C.C.No. 81/2008 dt. 4.1.2011, and the matter is remanded back to the District Forum, Chennai(South), for fresh disposal according to law.  Both parties should appear before the District Forum on 11.3.2019, the District Forum is directed to dispose of the case within 3 months, according to law, on merit.  There will be no order as to cost in this appeal.
