MR LAXMI NARAYAN PADHI, PRESIDENT… The factual matrix of complaint is that, the complainant had subscribed a policy with the OP.no.1 on dt.30.7.2009 vide policy no. U-244094588, bound to be matured on dt.30.1.15. The complainant submitted for reimbursement of all the benefits under the policy and thereafter numbers of correspondences, to which the OP.s did not paid any responses. Hence, for such unfair and arbitrary action of the OP.s she has sustained great mental injury hence filed this complaint praying for direction to OP.s for reimbursement of the amount against policy along with compensation of Rs.70,000/- including cost of litigation.
2. The complainant has filed copy of some relevant document, copy of letters of correspondence with OP.s and postal receipt thereof.
3. None for PACL appeared to counter the claim of the complainant. In the meanwhile it has come to the notice of this forum that, the Hon'ble Supreme Court vide it's order dtd.02.02 2016 in the matter of PACL Ltd vs SEBI in Civil Appeal No.13394/2015 was pleased to constitute a committee under the Chairmanship of Honble Mr Justice (Retd) R.M.Lodha empowering him to seize the property and sell them to refund the investors of PACL.
4. Hence, it is expected that, a public invitation will be made in near future investors to submit their documents for refund of their money.
5. Hence, the complainant is hereby advised to keep watch on public invitation in this regard to be published in news paper or website of SEBI, www.sebi.gov.in or contact free helpline no. 1800 266 7575 or 1800 227575 for further process.
6. As thus, being the matter with under seizure of SEBI and company law board, the forum losses it's jurisdiction, and the complaint is disposed off accordingly. No cost. Pronounced in the open forum today on 21.07.2016.
