Learned Counsel Sri Umesh Kumr Srivastava appeared for complainants.

Present complaint has been filed jointly by 13 complainants. The aggregate value of the flats of all complainants goes above Rupees One Crore which is beyond pecuniary jurisdiction of this State Commission.

In view of proposition laid down by Hon’ble National Commission in the case of Ambrish Kumar Shukla and others V/s Ferrous Infrastructure Pvt. Ltd. reported in 2016(4) CPR 83 NC the valuation of complaint shall be assessed on the basis of aggregate value of flats in question.

At this juncture learned Counsel for the complainants moved application for permission to withdraw the complaint with liberty to each complainant to file complaint separately.

In view of above complainants are permitted to withdraw this complaint with liberty to file fresh complaint in accordance with law.
