MR. BIBEKANANDA  DAS, MEMBER:-

           The Complainant has filed this C.C.Case No. 121/2023 U/s-35 of C.P.Act, 2019  seeking  direction for following relief:-

           “Hon’ble Commission directed  the Op to pay Rs. 1,26,200/- towards cost of E-Bike by complainant & also Rs. 2,00,000/- towards the compensate the financial loss & mental agony”.

              Heard Ld. Counsels for both the parties as agreed by both the parties. The Op No.1 shall replace/exchange the battery with a new one and fully repair the vehicle in all respect. The battery shall be replaced within a period of 30 days with warranty as applicable for new battery and at the time of instillation of new battery the repairing work of the vehicle as pointed out by the Complainant shall be done by the Op No.1.

With the aforesaid observation and direction the C.C.Case No. 121/2023 is allowed & accordingly disposed off.

                Issue extract of the order to the parties for compliance.   

           Pronounced in the open Commission, on this the 20^th day of December,2023.
