Final Order / Judgement

The Complainant filed this case against the o.ps with the allegation that the father of the complainant deposited a sum of Rs.50,000/- to UCO Bank, Borawar Branch, Rajasthan. In the said Fixed Deposit the mother of the complainant was nominated to receive the matured sum. Meanwhile mother also expired after the lapse of several years the matured sum was not provided to the complainant. The complainant requested the o.ps to release the fund after the lapse of several years a draft was issued to the complainant to the tune of Rs.3,00,380/- Since at the time of issuing the draft Income Tax was deducted and the interest provided to the complainant was not in conformity with the statutory interest prevailing at that time . the complainant filed this case praying for additional interest of Rs.68,288/- and Rs.5,00,000/- for compensation and Rs.25,000/- for litigation cost.

On perusal of the complaint petition as well as the annexure  filed  by complainant it appears that the Bank all through made correspondences with the legal heirs of the deceased account holder and with the maturity of the stipulated period as mentioned in the FDR time to time period was extended and the complainant enjoyed the interest  prevailing at that time. Apart from the said fact the Fixed Deposits were made in a branch situated in Rajasthan and simply because the head Office of the Bank is situated in Kolkata can not give any right to the complainant to file a case before this Forum. As such we hold that the complainant was provided with the amount calculated as per the Bank interest prevailing at the relevant point of time as well as this Forum has got no territorial jurisdiction to take cognizance  of the case. Therefore we are not inclined to issue notice against the o.ps accordingly the case is dismissed in limine.
