Shri S. K. Ojha, Sr. Member:- The complainant’s case in brief is that, he had contacted the O.P for hiring of services for Resume writing through online service. The O.P re-contacted through phone call to the complainant that his profile had been selected for Essar Steel and he had to come online to avail the service where the complainant was demanded Rs.1,900/- only for forwarding his resume. Thereafter the O.P demanded Rs.25,000/- only for verification services, Rs.30,000/- for creating unique ID. The complainant paid Rs.56,900/- in total to the O.P. The O.P demanded more amount for documentation purpose but the complainant refused to pay further and asked about his services, but the O.P stopped responding his calls and mails, hence this case.
Being noticed, the O.P Company neither appeared nor filed his written version. After not responding the notice through post this Hon’ble Forum sent notice through email (email address provided by the complainant) which the O.P has received but not replied. Thus, even after providing sufficient opportunities, the O.P set ex-parte ultimately.
Perused the complaint petition along with available documents, it is found that the complainant has paid Rs.56,900/- only in total to the O.P for availing of services of Resume writing and creating unique ID along with placement of profile to other companies for suitable jobs through online. The O.P after receiving the said amount from the complainant kept silent. It indicates clearly committing of deficiency in service on the part of O.P.
Hence we are in considered opinion to allow the complaint petition by directing the O.P to refund Rs.56,900/- ( Rupees six thousand nine hundred) only to the complainant along with pay a sum of Rs.20,000/- ( Rupees twenty thousand) only towards harassment mental agony and cost of the case within 60 ( sixty) days from the date of receipt of this order, failing which the O.P shall be liable for interest @ 10% per annum on the abovementioned awarded amounts till realization.
Accordingly the case is disposed of.
Order pronounced in the open court today on this the 15th day of December 2014, copy of this order shall be communicated to the parties as per Rule.
