Final Order / Judgement

ORDER BY HON’BLE MEMBER- MRS. M. SWAIN:

                                                                                           JUDGMENT

            Complainant has filed this consumer complaint U/s.35 of C.P. Act, 2019 seeking following reliefs;

            “Direct the opposite parties to provide NOC and pay Rs.3,65,000/- towards compensation”.

            The brief fact of the case is that, the complainant decided to purchase one AL 3718 to maintain her livelihood and the opposite parties agreed to finance the vehicle and financed Rs.27,78,500/- vide loan agreement No.6912811 and accordingly the complainant availed the vehicle vide Regd. No.OD-05-AQ-6713 by investing as down payment and the total payable amount will be payable in 37 monthly installments. Thereafter the complainant used to pay the installments in time and also paid some fines and other charges and requested to opposite parties for closure and after due calculation and as per the instruction of the opposite parties paid all the dues and after closure of the loan the opposite parties assured her to provide the NOC very soon. But the opposite parties deferred the matter showing some reason and others and even after repeated demand the opposite parties has not issued NOC to her, for which the complainant still waiting for NOC.

            The complainant paid all the EMIs to the opposite parties as per agreement and the status of loan is now “Closed- Normal” as submitted statement of accounts by the opposite parties on 14.9.2023.

            Hence it is ordered that the opposite parties shall issue NOC to the complainant within 30 days after receipt of the order or 45 days from the date of passing of the order, whichever is earlier, failing which Rs.100/- shall be given by opposite parties for each delay day of the complainant. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
