Final Order / Judgement

ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                                     JUDGMENT

            Complainant has filed an I.A. No.173/2023 U/s.38(8) of the C.P. Act 2019 (arising out of C.C. No.128/2023 & Misc Case No.151/2023) with a prayer that to modify the order dtd.22.6.2023 passed in I.A. No.151/2023 (arising out of C.C. No.128/2023) by permitting the complainant to pay 50% of the outstanding EMIs along with interest in 6 installments after payment of all EMIs of the loan account and not to take any coercive action in respect of the bus bearing No.OD-05-AM-2009 till disposal of the consumer complaint.

            Advocate for both parties are present. Copy served with objection. Heard the consumer complaint and I.A. The complainant is maintaining his livelyhood by engaging himself and in case the vehicle/asset will be repossessed, he will suffer irreparable loss. The opposite parties are directed not to repossess the asset (vehicle) bearing No.OD-05-AM-2009 of the complainant and the complainant is directed pay his monthly EMI regularly along with Rs.15,000/- in every month. If complainant has not comply the order then the opposite parties shall free to take action as per law. By the aforesaid order the earlier orders stand modified. Accordingly the I.A. as well as consumer complaint are disposed of. No cost.
