The appellants are the opposite parties in CC.77/11 in the file of CDRF, Idukki. The complaint stands allowed.
The dispute is with respect to the amounts paid regarding the vehicle loan provided by the appellants. The appellants were declared exparte before the Forum. It is submitted that counsel mistakenly noted a wrong date of posting and hence happened to be exparte. In the circumstances and in view of the fact that the order is an uncontested one the same is set aside on condition that the appellants/opposite parties pay a sum of Rs.6000/- towards cost to the complainant or deposited the same before the Forum which can be withdrawn by the complainant. On payment of cost, the Forum will permit the opposite parties to contest the matter; Parties are directed to appear before the Forum on 27.9.2011. The Forum will issue notice to the complainant.
