          This Revision Petition has been filed by the opposite parties in CC.658/11 on the file of CDRF, Thrissur challenging the order of the Forum dated, August 10, 2012 dismissing the I.A.648/12 filed by the 1st opposite party seeking to setaside the order of the Forum dated, May 2, 2012 setting him ex-parte.

 

          2.      Notice is issued to the respondent/complainant.  Both parties were heard.

 

          3.      It is submitted by the counsel for the respondent/complainant that the complaint before the Forum is posted to 26.4.2012 for filing version of the 2nd opposite party/2nd Revision Petitioner.  In the circumstances I feel that the order dated:2.5.2012 setting the 1st opposite party ex-parte has to be set aside and an opportunity should be given to him to contest the case on merits.

 

          In the result the Revision Petition is allowed.  The order of the Forum dated:2.5.2012 setting the 2nd OP/2nd Revision Petitioner exparte is set aside.  He shall file his version before the Forum positively on or before April 26, 2013.  Intimate the order to the Forum forthwith.
