        The Appellant is the opposite party and the respondent is the complainant in C.C.No.426/2010 on the file of District Consumer Forum – I, Hyderabad.   The Dist. Forum by the order dated 29.08.2012 partly allowed the complaint. 

           Aggrieved by the said order, the Appellant/ Opposite party  preferred this appeal, praying to set aside the order of the District Consumer Forum – I, Hyderabad and allow the appeal.

Heard Counsel for the Appellant / opposite party and also counsel for the Respondent /complainant.  Both of them have filed a Compromise Memo in which it is stated as follows: 

     “ The Appellant and Respondents do hereby agree for setting aside of order of Hon’ble District Consumer Forum-I, Hyderabad in CC.426/2010 dated 29.08.2012 by partly allowing the aforesaid appeal. The appellant as a goowill gesture has agreed not to claim amount of Rs.1,50,000/-(Rupees One Lakh and Fifty thousand only) towards full and final settlement  through Demand Draft vide No.072649 Dt.22.09.2016 for an amount of Rs.1,25,000/- of Vijaya Bank, Service Branch, Hyderabad  in favour of the Complainant.  An amount of Rs.25,000/- is already deposited before this Hon’ble Commission, by way of statutory deposit, at the time of appeal for which the Appellant / opposite party and has no objection to in Respondents withdrawing the same.”

          In the circumstances, appeal is disposed off accordingly.
