No. 1/20.04.2009.

HON’BLE JUSTICE SRI A. CHAKRABARTI, PRESIDENT.

Revision Petitioner is present through Ld. Advocate Mr. Bidyut Dutta.  Heard the Ld. Advocate in support of the application for condonation of delay.  The application has been filed challenging the order dated 29.08.2008.  The appeal was filed on 1st April, 2009.  The only explanation available in the application is in paragraph 10 onwards of the application.  We do not find any clear statement about person who was considering, about the authorities who were giving opinions and how long it was taken by each authority and in the circumstances as regards long delay of 221 days, no explanation at all is available.  Therefore, we are unable to condone the delay and the application is, therefore, dismissed.  The appeal accordingly stands dismissed.
