By Smt. Padmini Sudheesh, President:

The complaint is filed to get back the amount deposited with the respondent Company with interest as promised. The case is as follows. Believing the assurance given by the respondent, the complainant deposited Rs.50,000/- on 26.2.2001 for a period of one year and a deposit receipt was issued. The complainant demanded to return the amount on maturity. But the amount with interest has not been refunded. A lawyer notice was issued. Though the notice was accepted, there was no remedy. Hence the complaint.

            2. The respondent called absent and declared exparte.

            3. The complainant filed affidavit and produced the deposit receipt, which is marked as Ext. P1.

            4. The complainant has deposited Rs.50,000/- with the respondent company on 26.2.2001 and a deposit receipt was issued wherein it was agreed to return the amount on 25.2.2002 with an interest at the rate of 24%. The amount got matured but the money was not returned. The Ext. P1 receipt shows the deposit. There is no evidence to the contrary.

            5. In the result, the complaint is allowed and the respondent is directed to return the amount stated in Ext. P1 receipt with interest at the rate of 24% per annum from 26.2.2001 till realisation with cost Rs.1000/- (Rupees one thousand only) within two months.
