  1. This is an application   filed by the complainant U/s.27  of the Consumer Protection Act seeking to initiate necessary proceedings against the respondents/opposite parties for non-compliance of the common orders dated 27.4.2012 passed in CC 68 of 2010 on the file of this Commission and orders dated 08.07.2013 passed in FA No. 358 of 2012 on the file of the Hon’ble National Commission and punish them  as per the provisions of Section 27 of the Consumer Protection Act.

 

  1.  Counsel on both sides present. Heard.

 

  1. Counsel for the first opposite party filed Memo stating that he is  depositing cheque bearing No. 184458 dated 24.10.2016 for an amount of Rs.19,40,807/-  (Rupees Nineteen Lakhs Forty Thousand Eight Hundred Seven) only   towards EMI Interest amount payable to complainant with unregistered Unit who availed housing loan from ICICI Bank as per the statement provided by the said bank.  Counsel on both sides informed  that the petitioner has received the total amount and that  they have no claim against the respondents/opposite parties and requested to dispose of the case towards full and final settlement as settled out of court..

 

  1. In view of the above facts and circumstances Memo recorded and  the E.A. is closed as settled out of court towards full and final settlement. Since EA is closed, EAIA  470 of 2016 is dismissed as infructuous. No costs.
