Today is fixed for admission hearing.

The record is taken up for further admission hearing of the complaint.

Perused the complaint as well as Xerox copies of three documents.

From the complaint it appears that the complainant is the mother of the consumer Nandan Shil who took loan for the purpose of purchasing a vehicle and subsequently on 25/04/2018 he expired in an accident and the loan amount has been repaid to the O.P. It is alleged that she is the nominee to the O.P for the finance for which she went to the O.P to get the NOC. The O.P refused to give the same stating that the NOC has been given to Smt. Sampa Shil, W/o-Nandan Shil. For this ground this case has been filed by the complainant. But the complainant could not produce any document to show that she was the nominee.

Rather admitted that the NOC has been given to Smt. Sampa Shil W/o- Nandan Shil who is another legal heirs of Nandan Shil.

Therefore, this case has no leg to stand upon at all.

Upon this the above circumstances we are of opinion that the case is not admitted under the Consumer Protection Act.

Hence,
