Case called out. None for the appellant. Counsel for the respondent Shri S.K. Sharma appeared and stated that the matter has been settled between the parties. The appellant is not appearing for the last several dates and it appears that the matter has already been settled, therefore, the appellant is not appearing.

Under the circumstances, there is no reason to keep this appeal pending unnecessarily. Therefore, the appeal deserves to be dismissed.

Accordingly, the appeal is dismissed.
