ORDER

Aman vs. Luxmi Electric Store.

CC No. 57 of 2016.

 

Present: Complainant in person with counsel Sh. Nitin Chhabra Adv. 

              Sh. Harinder Kumar, Advocate, counsel for applicant/OP No.3.

              OPs No.1 & 2 already ex-parte.

 

                        Sh. Harinder Kumar Advocate, filed an application on behalf of Op No.3 for permission to join the proceedings alongwith power of attorney. However, counsel for Op No.3 made a statement that they are ready to pay a sum of Rs. 5850/- i.e. 75% of the billed amount. He further stated that the complainant will hand over the battery and accessories to him as the mobile set is already with the service centre and they will make the payment to the complainant within a period of 30 days. 

                        On the other hand, counsel for the complainant made a statement that in view of the aforesaid statement, he withdraws the present complaint, which may be filed.

                        Heard. The proposal made by the counsel for the OP No.3 for an amount of Rs.5850/-, subject to deposition of battery alongwith accessories, has been accepted by the complainant. Hence, we partly allow the complaint of complainant and OP No.3 is hereby directed to make the payment of Rs. 5850/- to the complainant, subject to deposit of battery alongwith accessories, within a period of 30 days failing which the OPs No.3 shall also liable to pay interest at the rate of 9% per annum for the defaulting period. Both the parties shall remain bound by their respective statement recorded separately. Copy of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
