By filing this appeal, Pragya Trust, Gurgaon–complainant has challenged the order dated July 20th, 2015 passed by District Consumer Disputes Redressal Forum, Gurgaon (for short ‘District Forum’), whereby, the complaint was dismissed in default.

2.      Learned counsel for the petitioner has urged that on July 20th, 2015, appellant was out station and it’s counsel had gone to the High Court.  When he went to the District Forum at 3 P.M, he was informed that the case was dismissed in default. 

4.      Be that as it may and without delving deeper, this Commission is of the opinion that ends of justice would be met if the impugned order is set aside and complaint is restored at its original number.  

5.       Accordingly, the appeal is accepted and the order dated July 20th, 2015 is set-aside.  The complaint is restored at its original number.

6.      The parties are directed to appear before the District Forum on November 26th, 2015.

7.      Copy of this order be sent to the District Forum.
