CONSUMER COMPLAINT NO. 239  OF  2023

ORDER

1.   Sh.Kartik Parmod Goyal, Advocate, has filed his memorandum of appearance on behalf of OP.

2.   OP has already filed miscellaneous application No.63 of 2023 for setting aside ex-parte order dated 04.07.2023 and seeking permission to take part in the proceedings. Today the complainant has made no objection if the application be allowed. In view of the no objection made by the complainant and for the ends of justice, the miscellaneous application in hand stands allowed and the order dated 04.07.2023 to the extent OP was proceeded against ex-parte is set aside. The miscellaneous application stands disposed of accordingly.

3.   At this stage, vide his separate statement, Sh.Kartik Parmod Goyal, Counsel for OP has stated that the matter has been settled between the parties and as per settlement, the OP shall pay a lumpsum amount of Rs.70,000/- to the complainant within a period of 10 days from today(03.11.2023) in full and final settlement of the present matter, failing which the OP shall be liable to pay the aforesaid amount alongwith interest @ 9% p.a. from the date of filing of present consumer complaint. Vide his separate statement, the complainant has admitted the aforesaid statement of counsel for OP and prayed that the complaint be disposed of in terms of aforesaid settlement.

4.   In view of the statements made by the counsel for OP as well as complainant and in terms of the settlement, the complaint stands disposed of by passing the following order:-

  1. OP shall pay a lumpsum amount of Rs.70,000/- to the complainant within a period of 10 days from today(03.11.2023) in full and final settlement of the present matter.
  2. In case OP fails to pay the aforesaid amount within the stipulated period, then OP shall be liable to pay the same alongwith interest @ 9% p.a. from the date of filing of present consumer complaint i.e. 02.05.2023 till the payment is made.

 

5.   The complaint is disposed of accordingly.

6.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
