On 27.9.2011, revision petition was adjourned to 2.11.2011 to enable the counsel for the petitioner to put on record the English translation of the order of the State Commission as well as the documents which were in Hindi.  Needful was not done.  A fax message was received on 1.11.2011 from the counsel for the petitioner seeking adjournment on the ground that he was suddenly taken ill and was unable to attend the proceedings.  The case was adjourned to 24.1.2012 with a direction to the office to inform the counsel for the petitioner about the adjourned date of hearing with a note that in case he does not file the English translation of the order of the State Commission and the documents which were in Hindi and if he does not appear on the next date of hearing, revision petition shall be dismissed for non-prosecution.  English translation was not filed.  Counsel for the petitioner again circulated a letter seeking adjournment, which was declined and the revision petition was dismissed for non-prosecution.

        Present application has been filed seeking restoration of the revision petition. 

Since this revision petition has been filed by the Complainant, in the interests of justice, we recall our order dismissing the revision petition for non-prosecution which shall be subject to payment of Rs.10,000/- as costs.  Costs be deposited in the Consumer Legal Aid Account.
