Heard Sh. Vijai Kumar Gupta, learned counsel for the applicant.

This miscellaneous application has been filed by the applicant for releasing the amount of Rs. 1,50,000/- (Rupees One Lac Fifty Thousand Only), which was deposited by the applicant before this Commission, in compliance of stay order dated 23.05.2018 passed by Hon’ble National Commission in Revision Petition         No. 1347 of 2018; The Head of Dehradun Circle, PNB House and another Vs. Lt. Col. (Retd.) Rakesh Bansal.  The said Revision Petition filed by the applicant has been dismissed by Hon’ble National Commission vide judgment and order dated 21.09.2021.

According to office report dated 02.12.2021, in compliance of the judgment and order dated 13.03.2018 passed by this Commission in First Appeal No. 112 of 2016; Lt. Col. (Retd.) Rakesh Bansal Vs. The Head of Dehradun Circle, PNB House and another, the applicant has deposited the entire decretal amount of Rs. 4,60,758/- (Rupees Four Lacs Sixty Thousand Seven Hundred Fifty Eight Only) in the account of the opposite party.

The factum regarding full and final satisfaction of the judgment and order passed by this Commission, find place in the office report dated 02.12.2021.

Considering the aforesaid facts and circumstances of this case, the grounds of this miscellaneous application appear to be proper and justified. 

Accordingly, the miscellaneous application is allowed and the aforesaid amount of Rs. 1,50,000/- (Rupees One Lac Fifty Thousand Only) deposited by the applicant with this Commission, in compliance of stay order dated 23.05.2018 passed by Hon’ble National Commission, be released in favour of the applicant.
