            This C.C. Case No. 124 of 2021 is taken up today for order.  Perused all the documents available on record and also gone through the order sheets. Complainant filed a complaint petition along with an interim petition against the O.Ps on dt.11.10.2021.  Accordingly notice was issued to O.Ps to file objection and this Commission directed the O.Ps not to take any coercive action against the vehicle bearing Regd. No. OD-06J-3250 till appearance of O.Ps.  On dt.30.10.2021 none appeared on behalf of the O.Ps and the complainant filed one continue petition and as such the interim order continued till dt.15.11.2021.  After perusal of order sheets it clearly shows that since dt.10.05.2022 till dt.21.04.2023 no steps has been taken by the complainant.  Many dates have gone since dt.10.05.2022 and this Commission duly intimated to the complainant to appear before this Commission but the complainant is not taking any steps to proceed with the hearing.  The learned Counsel for the O.Ps has filed one NOC dt.29.09.2022 in favour of the complainant (Copy annexed) and as such the complainant has got no case since the matter has already been settled between the parties and as a result of which the complainant remained absent till today after due intimation by this Commission and it seems that the complainant does not want to proceed with this case further.

            Hence, the present Consumer Complaint Case along with the Interim Application are hereby dismissed due to non-prosecution and accordingly disposed off.
