The complainant has filed the present complaint against <br /> Lovely Professional University, near Cheheru Bridge, Tehsil Phagwara District Kapurthala through its Registrar. claiming that complainant got admission in D.I.P. Engg. B.T. (Integrated ) B.T. in the opposite party University for the academic year 2007-08 and joined the course on 12.9.2007 in the opposite party University. It is further averred that thoroughly he was dissatisfied with the academic atmosphere in the University Campus as the classes were not held regularly and teaching factually was also casual in approach. That accommodation in hostel was also dingy and inhospitable and the complainant fell sick due to bad living and non nutritious food. He deposited a sum of Rs.17000/- in cash as fee and admission charges vide receipt No. 1113 dated 21.6..2007. Besides this he also deposited Rs.31,500/- in cash as hostel charges vide receipt No. 208 dated 21.6.2007. It is further averred that all the requests of the complainant to provide better living and nutritious food fell on deaf ears, therefore he decided to leave the University and he left the hostel and Campus on 5.10.2007 and as such made written request to the opposite party for the refund of the admission and hostel charges deposited by him with the opposite party as detailed above. But the respondents failed to refund the above amount to the complainant which is a deficiency in service on the part of opposite party. Hence the present complaint<br /> 2. Notice of the complaint was given to the opposite party who appeared before the Forum and request for a date for amicable settlement. Counsel for the opposite party made statements to the effect that a compromise has been effected with the opposite party and as per the said compromise, out of the total amount of fee Rs.47,500/- deposited by the complainant with the opposite party 75% of the above said amount which comes to Rs.35,625/- shall be paid back by the opposite party to the complainant. In view of the above, the counsel for the complainant made statement admitting the statement of counsel for the opposite party and submitted that the complaint be decided according to the statement of counsel for the opposite party.<br /> In view of the statements of counsel for the parties recorded on 27.1.2009, the complaint of the complainant is hereby allowed and opposite party Lovely Professional University, near Cheheru Bridge, Tehsil Phagwara District Kapurthala through its Registrar is directed to refund 75% of Rs.47500/- already deposited by the complainant with the opposite party within one month from the receipt of this order. Parties are left to bear their own costs.<br /> Let certified copy of the judgment be sent to the parties through registered post free of costs without any delay.
