        The order under challenge is dated 28.04.2017 passed by the Consumder Disputes Redressal Forum-X in Complaint Case No. 176/14 which reads as under:

        “28.4.17

        Present: Adv. Pawan Pandey for complainant.

        Adv. Akhilesh Tejpal, for OP.

        Come up for WA on 18.8.17.”

 

        By the aforesaid order matter is listed for final arguments.

        Counsel for the petitioner/OP has argued that an application has been filed before the Ld. District Forum for taking into consideration that the petitioner/OP has already refunded the amount to the respondent/complainant. It is submitted that the said application has not been listed for arguments and the matter has been straightaway listed for final arguments.

        Perusal of order sheet of District Forum shows that the defence of the petitioner/OP has already been struck down. The said order is not challenged by the petitioner/OP and the aforesaid order has been awaited and the matter is listed for final arguments.

        When the defence has already been struck down of petitioner/OP by the Ld. District Forum, the District Forum has not committed any illegality in fixing the matter for final hearing.

        The revision petition stands dismissed.

 

 

        A copy of the order be sent to the parties free of cost as well as to Ld. District Forum for necessary information.

        File be consigned to record room.
