          There is a delay of 108 days in filing of the present appeal. To condone the same M.A. No.95 of 2024, has been filed for seeking condonation of delay of 108 days in filing of this appeal and it is supported by an affidavit. It has been mentioned in the application that counsel appearing for the appellant suffered paralytical attack on right side of his body. He was hospitaised and because of this fact and as flowing consequences thereto; the appeal could not be filed within prescribed period of limitation. In the interest of justice, application is allowed for the reasons stated in the application and delay of 108 days in filing of this appeal stand condoned. Application for condonation of delay is disposed of accordingly.       

                   Learned counsel for the appellant has sought time to address arguments on preliminary hearing on main appeal. On request, case stands adjourned to 24.05.2024, for preliminary hearing on main appeal.
