1.  This OP had been lying  dormant from 11/08/2004   onwards.    Hence notice was issued to the parties to appear before this Commission on 12/11/2021.  When the matter was called  the counsel for the petitioner entered appearance. There was no representation for opposite parties.   
2. From a perusal of the records it has transpired that this claim  was one of the subject matter in   Company Application No.223/2004, in C.P.1017/2002 before    Honourable High Court of Mumbai  wherein a liquidator was appointed to consider the claim of the creditors of the company under winding up procedures.
3.  Hence the  complaint is dismissed.
