JUDGMENT

          This is an appeal filed by opposite party in C.C.No.459/14 challenging the order of the Forum dated 30, May 2015 allowing the complaint.

          2.  The complainant filed the complaint before the Forum claiming compensation for not conducting the repair works of the car

 

 

entrusted to them.  Appellant/Opposite Party remained absent before the Forum.  Therefore, Forum accepted the evidence of the complainant and marked P1 to P9 and allowed the complaint.  Opposite party has come up in appeal challenging the said order the Forum.

          3.  Heard the counsel for the appellant and the appellant and the authorized representative of the complainant Sri. Jose Grace.  Taking into account the nature of contentions raised by the parties we feel that an opportunity shall be given to the opposite party to contest the matter on merits.  But they remained absent after receipt of notice.  Therefore, appeal is allowed on condition that appellant pays a cost of Rs.3000/- to the complainant.

          4.  In the result appeal is allowed.  The impugned order of the Forum allowing the complaint is set-aside and the matter is remanded to the Forum for fresh disposal in accordance with law.  The opposite party shall pay the cost ordered directly to the complainant before the Forum.  Both parties shall appear before the Forum on 30/12/2015.
