ORDER

This is a complaint filed under Section 35 of the Consumer Protection Act, 2019.

2. The case of the complainant, in brief, is as follows:

On 15-12-2022 the complainant purchased a shirting cloth from the shop of the opposite party paying Rs.3,901/-. But on use after stitching, the colour of the cloth faded and the shirt was not fit for use. The complainant reported the same to the opposite party. But no positive steps were taken by the opposite party to redress the grievance of the complainant. Hence the complaint to direct the opposite party to pay Rs.3,900/-, being the price of the cloth and Rs.500/- towards stitching charges paid by him.

3. On receipt of notice, the opposite party initially appeared before this Commission, but subsequently remained absent and was set ex-parte.

4. The points that arise for determination in this complaint are :

1. Whether there was any unfair trade practice or deficiency of service on the part of the opposite party, as alleged?
2. Reliefs and costs.

5. The complainant was examined as PW1 and Exts. A1 was marked. MO1 was also identified.

6. Heard.

7. Point No.1– The complainant has approached this Commission with a grievance that the colour of the shirt piece purchased by him from the opposite party faded soon rendering the shirt stitched unfit for use and the opposite party neglected to take any action to redress his grievance.  

8. PW1 has filed proof affidavit in terms of the averments in the complaint and in support of the claim. Ext A1 is the copy of the invoice dated 15-12-2022 issued by the opposite party. MO 1 is the shirt.

9. The evidence of PW1 stands unchallenged. The opposite party has not turned up to file version. The opposite party has not produced any evidence to disprove the averments in the complaint or to rebut the veracity of the documents produced and marked on the side of the complainant. The case of the complainant stands proved through the testimony of PW1 and Ext A1 and MO1. Unfair trade practice and deficiency of service on the part of the opposite party is established and proved. The opposite party is bound to refund the price of the cloth amounting to Rs.3,900/- and also stitching charges amounting to Rs.500/- to the complainant.

10. Point No.2 :  In the light of the finding on the above point, the complaint is disposed of as follows:

1. CC 108/2023 is allowed in part.  
2. The opposite party is hereby directed to pay a sum of Rs.4,400/- (Rupees Four thousand four hundred only) to the complainant, being the price of the cloth and stitching charges.
3. The payment as aforestated shall be made within 30 days of the receipt of copy of this order, failing which, the amount of Rs.4,400/- shall carry an interest of 6% per annum from the date of this order till actual payment.
4. No order as to costs.
