ORDER

At the outset, learned Counsel appearing for the Respondent/Complainant submits that in order to avoid further delay in disposal of the Complaint, the Complainant would not object to the grant of some reasonable time to the Appellants to file their Written Version, provided the Complainant is adequately compensated for the delay already caused.

               In view of the submission on behalf of the Complainant, and bearing in mind the observations by the Hon’ble Supreme Court in order dated 10.02.2017 in Reliance General Insurance Co. Ltd. And Anr. vs. M/s Mampee Timbers And Hardwares Pvt. Ltd. And Anr. (Diary No.2365 of 2017), we dispose of the Appeal with a direction that if the Appellants file their Written Version in the Complaint (No.CC-478/2013), within                    30 days from today, the same shall be taken into consideration, subject to the Appellants’ paying to the Complainant costs of ₹25,000/-.  The said costs shall be paid before the State Commission on the next date of hearing.  The Complainant may file rejoinder affidavit to the said Written Version, on the next date of hearing before the State Commission, if so advised.

               The Appeal stands disposed of in the above terms with                     no order as to further costs.
