Ld advocate for the Op life Insurance company is present by filing hazira on behalf of Ops It appears from case record that 28.11.18 was fixed for argument and next e of argument was fixed on 20.12.18 but on that date through Ops remained present & took steps, None remained present for complainant on repeated calls of the case  neither the complainant no Ld advocate on his part found available. However, the case was adjourned with a direction to the complainant to file  show cause on the next date contending as to why the case shall not be dismissed for default. On the next date none appears and  considering the situation that local Bar resolution was there not to pass any adverse order. No such order was  passed and simply it was refixed on this date for filing show cause by complainant or from complainant’s side. But unfortunately no steps taken today by complainant. On repeated calls of the case at 12.30.p.m. neither the complainant nor Ld advocate on behalf of complainant or none is present. It appears to us on consideration that complainant is not willing to proceed with this case further so he did not avail the opportunities of filing show case even.

Hence it is,

 ORDERED

 That the instant case be and same is dismissed for default . No order as to cost.
