Final Order / Judgement

Reply to the questionnaire is filed by the complainant with copy to the Ld. Advocate of the OP.

The Ld. Advocate of the complainant concedes to the submission of the Ld. Advocate of the OPs that Rs. 1,00,000 has already been paid by the insurer to the complainant. But it is ascertain by the Ld. Advocate of the complainant that the complainant would get some amount on account of interest due to the delay cost by the insurer in awarding compensation.

It is admitted by the Ld. Advocate of the complainant that Rs. 1,23,300/- plus 1,00,000/- totaling Rs. 2,23,300/- has already been given by the insurer to the complainant due to the death benefit arising out of the death of the insured person.

It is ascertained that there was delay of negligible period in making payment of Rs. 1,00,000/-. However it the ends of Justice and with the consent of the Ld. Advocate of the complainant, the Ld. Advocate of the OP is directed to pay Rs. 3000/- on account of interest as full and final satisfaction.

Hence it is ordered that the case be and the same is disposed of otherwise without cost.

The OP will pay Rs. 3000/- within a period of 30 days hence to the complainant in cheque or Demand Draft or otherwise.

Let plain copy be given to the parties, free of cost, as per CPR.
