Final Order / Judgement

Heard Mr. S. Chauhan, learned counsel, appearing for the appellant.

This appeal has been filed against the order dated 24-01-2020 passed by the District Forum, in C.C. No. 12 of 2017, by which the petition filed by the opposite party, praying for calling the original school certificate from the Head Mistress, Konwarpur Girls’ M.V. School, Konwarpur, Sivasagar, and also to direct the complainant to produce the original school certificate from their possession, was allowed by the District Forum and against the said order, this appeal has been preferred.

The basic argument submitted by the learned counsel appearing for the appellant is that when the direction was given to produce the original school certificate, he was not given any chance for objection against the said petition. From the impugned order we found that the District Forum has only directed to take steps for production of the said document from the custody of the above mentioned party. Once such steps are taken, the appellant will get chance to submit their version as to whether the said document is in their possession or not or whether there is any objection in production of the said document.

The appellant also in para 8 of the appeal memo has submitted that several adjournments were allowed to the opposite parties to file their evidence for which they have suffered as the case got delayed in disposal. According to him, the District Forum while granting such adjournment, did not recorded any reason and granting of such adjournment was without jurisdiction. We found from the record that evidence was submitted by the opposite parties and that was accepted by the District Forum with a cost of Rs. 500/-.  In view of the fact that since evidence has already been submitted, we are of the opinion that at present there is no scope for agitating the matter of allowing several adjournment by the District Forum to file evidence by the opposite party.

In view of the above position, the present appeal is not maintainable and hence it is not admitted.

The appeal is disposed of accordingly.
