               Complaint presented today. It be checked and registered.

               The complainant has filed the present complaint under Section 35 of the Consumer Protection Act, 2019 against the opposite parties (hereinafter referred to as (OPs) on the averments that the husband of the complainant Sh. Jugbir Singh son of Sh. Ramdhari was insured with OP company for an amount of R.1,00,000/- vide policy no.178493441 dated 10.05.2018. The said policy was under New Jiwan Anand Plan and was for a tenure of 10 years. The premium of the installment was fixed for Rs.8890/ per year. The complainant was appointed Nominee by her husband. The date of maturity of the said policy was 28.12.2029.

                  That the husband of the complainant expired on 28.12.2020. The husband of the complainant had been regularly paying the installments of the above said policy and had paid all the due installments prior to his death. After the death of the husband of the complainant, the complainant has become entitled to an amount of Rs.1,00,000/ which was sum assured on death under the policy. Complainant further alleged that her husband had also insured with the OP for a sum of Rs.1,00,000/ vide policy no.172420634 dated 28.03.2001 for a period of 20 years at a half yearly premium installments of Rs.3330/. The husband of the complainant had been regularly paying the installments under the above said policy upto 28.09.2020 before his death. The maturity date of the policy was 28.03.2021. The complainant is entitled to an amount of Rs.1,00,000/ beside the other benefits under the policy which is 40% of the sum assured + vested bonus. Complainant approached many times to the Op for maturity amount but OP did not heard the genuine request of the complainant. Hence, filed this complaint.

                 As per version of the complaint, two policies in question were purchased by her husband firstly on 10.05.2014 and secondle on 10.05.2018 prior to death of her husband, he had paid all the installments of the policies.

     On perusal of the file, the complainant has placed only copy of both policies no other documents attached with complaint. To prove the facts that the husband of the complainant has deposited the premium amount after purchasing the said policy no premium receipts has been placed on file. It has not been proved on the file that the husband of the complainant has deposited the premium amount and one of the policies in question still exists. Hence, the complaint is devoid of merits and deserves to be dismissed and same is hereby dismissed. However, complainant is at liberty to file a fresh complaint on placing on record the receipts and other proof with regard to the deposition of the premium amounts, if so desires. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
