1. This is an order for petition filed on behalf of the Complainant Ruth Topno w/o Late Patras Topno, M/O Late Silwanti Topno resident of village- Torpa, Sarna Toli, P.S- Torpa, District- Khunti against The Life Insurance Corporation of India, Hinoo Branch, Ranchi.

2. The Complainant contended that her deceased daughter purchased four policies from LIC of India.  Details of the policies are as follows:-

3. The Complainant contended that her daughter Shilwanti Topno was appointed as Assistant Teacher in RC Primary School, Bundu Mamail in  the District Khunti and she was in regular service. The Complainant also contended that Shilwanti Topno died on 03.06.2011 and the death certificate was issued. The Complainant stated in the complaint petition that prior to death of her husband namely Modmasih Soy, son namely Neeraj Amarjeet Soy, her father-in-law namely Suleman Munda and her mother-in-law namely Salomi Soy has already expired and as such the deceased employee Shilwanti Topno was living with the petitioner. The petitioner who was totally dependent upon her daughter deceased Shilwanti Topno.

4. The petitioner contended that she is the only alive member. Hence she claims the maturity amount of all four policies from LIC of India in the light of an order passed by the Hon’ble High Court of Jharkhand, Ranchi in W.P no.2456/2015 dated 21.07.2016. The Hon’ble High Court of Jharkhand  has accepted Late Shilwanti Topno’s mother as her legal heir in its order and has directed to give the family pension to complainant Ruth Topno.

5. The complaint case was filed before this Forum on 04.08.2018, the same was admitted and notice against the opposite party was issued through registered post. The Opposite party did not appear and not shows any interest in this case. Where as the track report shows that notice issued against the opposite party served properly but the Opposite party did not appear. The case was fixed for ex-parte hearing.

6. The petitioner claims the maturity amount with interest of all four policies of LIC of India on the basis of order passed by Hon’ble Jharkhand High Court, Ranchi in W.P(s) no.2456/2015 dated 21.07.2016 and she is the only alive member of the deceased Shilwanti Topno.

7. In this case the complainant in support of this case filed some documents. The document submitted by the Complainant are marked as Exhibit.The copy of order passed in W.P.(s) No. 2456 of 2015 by Hon’ble Jharkhand High Court, Ranchi for the family pension allow to Ruth Topno as Exhibit- 1, first page of the policy bond of LIC vide no. 555691092 as Exhibit-2, first page of the policy bond of LIC vide no. 554888009 as Exhibit-3, first page of the policy bond of LIC vide no. 551571777 as Exhibit-4, first page of the policy bond of LIC vide no. 333320234 as Exhibit-5, death certificate of Niraj Amarjeet Soy issued by the government of Jharkhand as Exhibit- 6, death certificate of Shilwanti Topno issued by the government of Jharkhand as Exhibit-7, death certificate of Modmasih Soy issued by the government of Jharkhand as Exhibit- 8, death certificate of Salomi Soy issued by the government of Jharkhand as Exhibit-9, death certificate of Suleman Munda issued by the government of Jharkhand as Exhibit- 10, family list as Exhibit-11.

8. An affidavit filed by Jolen Topno for no objection. Jolen Topno is sister of deceased Shilwanti Topno shows in family list.

9. Considering the above stated facts and circumstances the Forum hold that the Complainant is entitled to get the maturity amount of the policy nos. 555691092, 554888009, 551571777 and 333320234.

A N D

In the result the opposite party Life Insurance Corporation of India is directed to pay the maturity amount of policy nos. 555691092, 554888009, 551571777 and 333320234 which stands in the name of Shilwanti Topno to the Complainant namely Ruth Topno the complainant within 45 days of receiving of this order according to  terms & conditions of the policies and litigation cost Rs.5,000/-. Failing which the Complainant shall be entitled to get interest @8% per annum from the date of this order.

10. Give free copy of this order to the Complainant and send the copy of this order to the Opposite Party by registered post.
11. In case of failure of comply the order by the opposite party the Complainant shall be entitled to get the order executed through the process of the law.
