ORDER

Petitioner’s wife took an insurance policy for a sum of Rs.1 Lac on 19.03.1995.  She died due to brain hemorrhage on 12.10.1996, i.e., within two years of taking of the policy.  Claim filed by the petitioner was repudiated by the respondent insurance company on

the ground of suppression of material facts.  Being aggrieved, petitioner filed the complaint before the District Forum. 

          District Forum allowed the complaint and directed the petitioner to pay the insured amount with all benefits along with interest at the rate of 9% per annum.  Rs.1,000/- were awarded towards costs.

          Respondent being aggrieved filed the appeal before the State Commission.  The State Commission allowed the appeal and set aside the order passed by the District Forum.  The State Commission came to the conclusion that the petitioner was guilty of suppression of material facts.

          On the last date of hearing, i.e., 02.05.2011 we did find any merit in this revision petition and adjourned the case for today to enable counsel for the respondent to get instructions to pay Rs.30,000/- as ex gratia payment to the petitioner. 

Counsel for the respondent after taking instructions states that the respondent shall pay Rs.30,000/- by way of ex gratia payment to the petitioner.  Counsel for the petitioner accepts the offer.

Revision petition is dismissed.

Respondent is directed to pay Rs.30,000/- to the petitioner as ex gratia payment within four weeks.
