Heard on the point of admission. Briefly stated, the case of the complainant is that husband of the complainant namely Joginder Singh was insured with the OP No.3. He was having good health at the time of taking policy. He was not suffering from any disease prior to obtaining the policy. It is further pleaded that after long time, her husband Joginder Singh, suffered from high fever for many days. He had gone very weak, which resulted in deteriorating of his health and ultimately he died on 23.7.2012.Intimation of the death of Joginder Singh was given to the OPs. Complainant applied for insurance claim with all the benefits but the OPs repudiated the claim vide letter dated 30.3.2013. It is further pleaded that the complainant had been visiting again and again in the branch office as well as Divisional office but she was always assured to get claim within short period. The complainant also got issued registered notice dated 25.1.2018 but to no effect.

On the background of these facts, the complainant has filed this complaint for insurance claim of Rs.2lacs with all the benefits being widow of Joginder Singh. She has also claimed interest @12% per annum on this amount. Hence this complaint.

Alongwith the complaint, the complainant has also filed an application to condon the period of three years in filing the complaint.

  1. We have heard the ld. counsel for the complainant.
  2. The claim is regarding the death of Joginder Singh, husband of the complainant. Joginder Singh died on 23.7.2012.As per complainant herselff, the OPs repudiated the claim vide letter dated 30.3.2013. Therefore, the cause of action accrued to the complainant on 30.3.2013.Complaint was to be filed within two years from the date of cause of action i.e. 30.3.2015. Complainant has prayed for condonation of delay of three years. The main ground for claim of condonation is her illiteracy. There is a delay of more than three years in filing the complaint.There is no ground to justify condonation of such a long delay. Therefore, the complaint is time barred. As such stands dismissed.

          Certified copy of this order be sent to the complainant free of cost under the Rules. Thereafter, file be indexed and consigned to the Record Room.
