(1)               Learned counsel for the appellant filed authority letter, which is taken on record. 

(2)               In the instant case, policy proposal in respect of late Meena Jethalal Shah was moved on 30/04/2008 i.e. last working day of that financial year.  On scrutiny of the proposal, the insurance company found it not possible to accept the proposal.   The decision thereof was communication on 26/12/2008 by the insurance company.  The insurance company also replied through their agent on 18/02/2010 (Exh-8).  Considering these aspects and in view of the fact that proposal was not accepted by the insurance company the Forum rightly held that there was no concluded contract regarding insurance and as such no deficiency in service in respect of repudiation of the claim could be alleged.   We are in agreement with the forum below.  The appeal is devoid in substance.  Hence, we hold accordingly and pass the following order.

ORDER

(1)     The appeal is not admitted and stands disposed off.
