The Representative of the complainant is present.  On perusal of the complaint petition it appears that Rupanjana Manna, on his favour the policy was issued in the policy of LICI bearing No. 413489160 where Ratna Manna being mother is as nominee in the said policy and it is found that Malay Kanti Manna being father of the son Rupanjana Manna since deceased has filed the instant case.

In view of the above, we are of the opinion that Ratna Manna (Nominee) being mother of deceased son could have been filed the instant case. 

Considering the facts shown afore we are not inclined to admit the Consumer Complaint.  The complainant is at liberty to file afresh on the same cause of action in appropriate Forum or Court of Law if so advised and if not otherwise barred by law.

Hence, the CDF, Unit-II CC No. 101/2023 is thus disposed of.
