Complainant absent.

Attendance on behalf of the OP has been filed through his  advocate. Present complaint has been filed  alleging non payment of  the  fraction  of sum assured on survival under maney  back  policy for the  amount payable in 2010 and  2015.

Learned advocate for the OP has produced the enquiry vouchers of payments made to the  complainant. From perusal of  the enquiry vouchers it appears that fraction of  the sum assured payable in 2010 was credited in the  complainant’s account  on 06.12.2010 vide  cheque no-32519 which  was incashed and  that payable  in 2015 was credited in the  complainant’s account on 28.08.2015 vide  cheque no-48915 dated 28.05.2015 which was also  encashed.  As such, the claim of the  complainant is  absolutely false and  mis-conceived from perusal of the record it appears that the complainant is absent since 23.02.2022 and only casually on 28.07.2022 has  filed  his attendance and since thereafter is  regularly absent till date. It appears that  in view of the  report  of enquiry vouchers submitted by the learned advcoate for the  OP showing payments of the due amount in the year 2010 and 2015, complainant  has lost interest in persuing this  complaint.

Hence, the complaint petition is dismissed for want of merit as well as for  non-prosecution since 26.08.2022.
