This complaint is coming on this day for orders in the presence of Sri.P.Siva Sudarshan, Advocate for complainants and Sri.L.Hari Hara Natha Reddy, Advocate for opposite parties and upon perusing the material papers on record, the Forum made the following.

                                     ORDER

(As per Sri. M.Krishna Reddy, Male Member, PRESIDENT (FAC))

   C.C. No.103/2012

1.     This complainant filed this case under section 11 and 12 of C. P. Act, 1986 seeking a direction on opposite parties for the payment of:-

1. To pay the policy amount of Rs.75,000/- to the complainant with interest at 24% per annum from the date of death of complainant husband i.e., 03-11-2009 till the date of realization along with benefits;

1. To grant a sum of Rs.20,000/- towards mental agony;

1. To grant a sum of Rs.5,000/- towards cost of the complaint;

2. To grant any other relief as the Honourable Forum deems fit and proper in the circumstances of the case.                                   

2.    Opposite parties filed a memo stating that the matter is settled out of Forum and deposited a Demand Draft bearing No.605463 dated 28-02-2013 for Rs.83,400/- in the name of President District Consumers Forum, Kurnool.  The complainant also filed another memo accepting the settlement amount and prayed for the distribution of the said amount equally among the two complainants.

        As per the death certificate on record, issued by Executive Officer, Peapully Gram Panchayat the nominee of the insured died and according to the Certificate of Family Members issued by Tahsildar, Peapully.

2. Sri.Dhimmigudi Eswara Reddy.

Who are the complainants of this petition are the Family Members.  Both the complainants are entitled to receive the settled amount equally in view of the above certificates.  Hence the complainant is closed with a direction to the complainants to apply for the payment of the said amount on the receipt of this order.
