Final Order / Judgement

On perusal of file, it has come into notice of this Commission that neither complainant nor his counsel is appearing in this case to lead evidence to prove his version.  Today also the present complaint is fixed for tendering evidence by complainant subject to last opportunity otherwise the complaint shall be dismissed for want of prosecution but today neither complainant nor his representative has appeared in-spite of repeated calls. On perusal of case file, it has come into notice of the Commission that the case for evidence of complainant was fixed for 15.12.2021 and since then it has been adjourned time and again for the same purpose but the complainant failed to tender his evidence.  It is 12.00 P.M.  Let, case file be again put up after lunch break.

                        Case file taken up but this time also neither complainant nor his representative appeared before the Commission.  Case called several times. It is 3.50 P.M. Waited sufficiently. Further wait seems not to be justified. Accordingly, we have no option except to dismiss the present complaint for want of prosecution.  Hence, the present complaint is hereby dismissed in default for want of prosecution. Certified copies of the order be sent to the parties concerned, as per rules. File after due compliance be consigned to the record room.
