Ld. Advocate Mr. saikat Mali is present on behalf of the Decree holder and Ld. Advocate Mr. Avik Kumar Das along with his junior Ld. Advocate Mr. Avishek Sengupta are also present on behalf of the Judgement debtor.
As per direction LICI files demand draft of Rs.5,84,838/- in two different demand drafts.
Demand draft issued in the name of Sujoy Mitra vide demand draft no.146251 dated 05/05/2022 amounting to Rs.2,92,219/- and another demand draft in the name of Susmita Mitra vide demand draft no.146250 dated 05/05/2022 amounting to Rs.2,92,219/-. Both the demand drafts is handed over to the Ld. Advocate Mr. Saikat Mali who is appearing on behalf of the Decree holder and also files money receipt on behalf of the Decree holder.
One copy of money receipt be handed over to the Judgement debtor i.e. LICI for their official record.
Ld. Advocate for the Decree holder further submits that Decree holder also entitled to get interest as per judgement i.e. @4% from the date of filing.
In this regard, Ld. Advocate for the LICI submits that as per direction of this Commission LICI authority issue the demand drafts without any further query according to the direction of this Commission.
Considering that and also considering the submission of both the sides the interest @4% be waived from 27/04/2021 to till date.
Ld. Advocate also pointed out from the judgement Page No.4, Second Paragraph wherein Judgement debtor Insurance Company agreed to make payment the gratuity of Rs.4,428/-. LICI i.e. Judgement debtor after consultation with the official agreed to pay this amount of Rs.4,428/- in the bank account directly through NEFT to the respective Decree holder.
Hence, it is
O R D E R E D
that this execution case be and the same is disposed of with full satisfaction.
