Final Order / Judgement

            The complainants filed this case stating inter alia that Mrs. Namita Mitra bona fide policy holder continued the policy since the year 2007 till her death being policy no.693223 and the group insurance scheme is a OYRGTA (one year renewal group term assurance) policy for agents providing coverage from 1st Sept. to 31st Aug. next year. The annual premium was of Rs.1200/- which was paid by the complainant and the sum assured was of Rs.5 lakhs and with the death of Mrs. Namita Mitra the complainant claimed the said amount. It appears from the record that the said policy holder died in the year 2012. On perusal of the record we find that the complainant has claimed that the claim of the complainant was repudiated by o.p. On the basis of the said fact the complainant filed this case.

            On perusal of the record we find that the insurance company submitted a document before CA & FBP, Govt. of West Bengal wherein it was stated that group insurance scheme OYRGTA policy for agents providing coverage from 1st Sept. to 31st Aug. next year. As per rules annual renewal date for the said scheme is 1st Sept. of every year and premium is to be recovered from commission of Aug. payable in Sept. every year, since Late Namita Mitra the commission for the month of Aug. 2012 was Rs.1049.74. The required yearly premium was Rs.1500/- for continuance of her insurance coverage since the commission amount for 2012 was not sufficient for premium deduction for the renewal date of 1.9.12, the insurance coverage could not be continued, therefore the coverage of Rs.5 lakhs is not payable. The policy no.41021760 on the life of Mrs. Namita Mitra matured in Oct. 2003 the issue of non payment was not raised by her during her lifetime. The said intimation was given to CA & FBP, Govt. of West Bengal on 20.4.15 which was also informed to the complainant and the period of limitation for filing of the case is of two years if that date is considered to be a date of repudiation of claim of o.ps. Since the case filed by the complainants beyond the period of two years. Therefore, we hold the case filed by the complainant has got no merit, the complainants will not be entitled to get any relief as prayed for.

            Hence, ordered,

            That the CC No.31/2018 is dismissed in limini.
