Heard Sh. Chaitanya Rajvanshi, learned counsel for the complainant, on admission.

This consumer complaint has been filed by the complainant against the opposite party – Life Insurance Corporation Housing Finance Limited for return of the documents which were handed over by the complainant to the opposite party at the time of taking loan by way of equitable mortgage.  Second prayer has been made for award of compensation of Rs. 40,00,000/- in lieu of loss of original documents of title, thereby causing the value of the property to diminish manifolds, causing irreparable loss to the complainant along with interest @18% p.a.

By a perusal of the contents of the consumer complaint and issue involved in the matter, we are of the view that the consumer complaint has been overvalued and there is no question of compensation of more than Rs. 20,00,000/- in the present matter. 

Therefore, consumer complaint is rejected on the ground of jurisdiction.  However, the complainant would be at liberty to file the consumer complaint before the District Forum having jurisdiction in the matter.  The demand draft of Rs. 4,000/- deposited by the complainant at the time of filing the consumer complaint, be returned to the complainant.
