          Tara Chand-since deceased, husband of complainant/appellant, obtained three Life Insurance Policies from Life Insurance Corporation of India (LIC)-Opposite Party/respondent. The sum assured for two policies was Rs.3.00 lacs each and third policy was of Rs.1.00 lac. Thus, the total sum assured was Rs.7.00 lacs. The insured died. The complainant filed claim with the LIC but the LIC repudiated the claim. Hence, complaint under Section 12 of the Consumer Protection Act, 1986 was filed before District Consumer Disputes Redressal Forum, Rohtak (for short ‘the District Forum’).

2.                Vide order dated 28th April, 2016, the District Forum allowed the complaint directing the LIC as under:-

“10.   As such it is observed that opposite party shall pay the death benefits under the policies No.172208461, 174577567 and 173059008 amounting to Rs.300000/-, Rs.300000/- and Rs.100000/- respectively i.e. total Rs.700000/- (Rupees seven lacs only) alongwith interest @ 9% p.a. from the date of filing the present complaint i.e. 22.09.2014 till its actual realization other benefits under the policy, if any and shall also pay an amount of Rs.3500/- (Rupees three thousand five hundred only) as litigation expenses to the complainant maximum within one month from the date of decision failing which the awarded amount shall carry further interest @ 12% p.a. from the date of decision. Complaint is allowed accordingly.”                              

3.                By filing this appeal the prayer made is to enhance the rate of interest from 9% to 18% per annum.

4.                Indisputably, the sum assured was Rs.7.00 lacs and that amount has been awarded to the complainant alongwith interest @ 9% per annum from the date of filing complaint till its realisation. Besides, the complainant has been awarded compensation of Rs.3500/- litigation expenses.

5.                In view of the above, the complainant has been adequately compensated and there is no scope for enhancement of interest. Hence, the appeal is dismissed.
